SUBJECT: U.S. Department of Labor’s Administrative Procedures for Reporting Known and/or Suspected Fraud, Abuse, or Criminal Conduct
Pursuant to the requirements of the State of Michigan’s Department of Energy, Labor & Economic Growth (hereinafter “DELEG”), as provided its Workforce Programs Policy Issuance (No: 05-02), Genesee/Shiawassee Michigan Works! Career Alliance, Inc. (hereinafter “GSMW/CAI”) or “the Agency” hereby transmits the U.S. Department of Labor’s (hereinafter “USDOL”) Incident Report Procedures for reporting known or suspected fraud, abuse, or criminal conduct related to the USDOL Employment and Training Administration (“ETA”) and WIA funded programs:
A. Purpose
Genesee/Shiawassee Michigan Works! Career Alliance, Inc. (hereinafter “GSMW/CAI”) provides for concurrent oversight activities initiated by local, State, and Federal entities in the Job Training System. WIA Regulation Section 20 CFR 667.630 of the USDOL Training and Employment Guidance Letter (TEGL) No.6-84 provides instructions for reporting known and suspected fraud, abuse, or criminal conduct related to the USDOL ETA funds that are passed through the Department of Labor & Economic Growth (DELEG), including WIA funds.
B. Incident Reporting Administrative Procedures
In order to facilitate the reporting process, the USDOL has developed procedures and standardized forms for reporting incidents involving any act which raises questions concerning possible illegal expenditures or other unlawful activities.
(1) USDOL Form DL 1-156, Incident Report, is to be used to notify regional administrators of all known or suspected cases of fraud, abuse, or other criminal activities in USDOL ETA-funded programs (See Attachment A for Form DL 1-156, “Use and Preparation of DL Form 1-156” and “Definition of Terms”) The original and one (1) copy of this form are to be forwarded to:

(2) Within one (1) work day of the discovery of the occurrence, the regional administrator will immediately distribute the Incident Report in accordance with established USDOL procedures. A copy of the DL 1-156 shall also be sent to:

Further, CAI and its Service Providers of USDOL ETA funds and their staffs shall forward Incident Reports concerning such funds that are passed through the DELEG Bureau of Workforce Programs to the regional administrator within one (1) work day of the discovery of the occurrence.
(3) It is not the intent of the Incident Report to elicit reports only after determination that an act or allegation is legally prosecutable. All such incidents shall be reported immediately even though the case may be subsequently handled by the state, county, city, or local law enforcement agencies.
(4) USDOL Hotline. Although it is anticipated that the incident reporting procedures outlined above will be utilized to report matters to the regional administrator, Career Alliance, Inc. as well as the Service Providers of USDOL ETA and WIA funds and their employees are hereby notified of the availability of the USDOL Hotline (1-800-347-3756) for providing information confidentially.
The Hotline was established for employees and the public to notify the Office of Inspector General (“OIG”) of suspected fraud, abuse, or waste in USDOL-funded programs. The Hotline permits reporting of matters anonymously, if desired, to avoid fears of reprisal.
Information supplied via the Hotline should be as specific as possible to enable the OIG to identify and address the problem. The Hotline should not be used for resolving employee grievances, equal employment opportunity complaints, labor disputes, or other personnel concerns.
